1. Introduction & Acceptance of Terms

Welcome to MingCharts ("MingCharts", "we", "us", "our"). MingCharts is operated by Jin Chen (金晨), an individual (natural person) operating under the laws of the People's Republic of China.

These Terms of Service ("Terms") govern your access to and use of our AI-powered Chinese astrology (BaZi) services, including chart calculation, written reports, daily readings, and related content, available at https://mingcharts.com (the "Service").

By creating an account, subscribing to any plan, purchasing any report, or otherwise using the Service, you confirm that you: (a) are at least 18 years of age; (b) have read, understood, and agree to be bound by these Terms; (c) agree to our Privacy Policy; and (d) are authorized to enter into this agreement on behalf of yourself or any organization you represent.

⚠️ Important: If you do not agree to these Terms, you may not use the Service. Continued use after any update constitutes acceptance of the revised Terms.

2. Service Description

2.1 What We Provide

MingCharts provides an AI-powered platform that enables users to generate Chinese astrology (BaZi) charts and interpretive content. The Service includes:

• Chart calculation — Four Pillars (BaZi), Luck Cycles (Da Yun), annual and monthly cycles, and related calculations based on the birth information you provide;
• Written reports — AI-generated interpretive reports covering career, wealth, relationships, health tendencies, and related topics;
• Subscription content — personalized daily readings, monthly cycle notes, and related recurring content;
• Reference material — a searchable library of classical BaZi case records with cited sources.

The Service is a digital software-as-a-service (SaaS) product delivered via the internet.

2.2 Nature of the Service

The Service is a digital, intangible product. Upon confirmed payment, access is granted immediately. Due to the immediate digital delivery, specific limitations apply to refunds as described in Section 7.

2.3 ★ Nature of the Content — Important

The Service produces Chinese astrology (BaZi) interpretations based on traditional Chinese metaphysical frameworks and classical texts. This content:

• is presented for cultural, reflective, and entertainment purposes;
• is not a factual prediction of future events, and not a statement of scientific fact;
• must not be relied upon as a substitute for professional medical, legal, financial, psychological, or other professional advice.

We make deliberate efforts to disclose the basis of each interpretive statement (whether it derives from classical texts, traditional practice, folk custom, or our own product design). Please read Section 12 carefully.

2.4 ★ Underlying AI Model Disclosure

The Service uses one third-party AI model provider: DeepSeek, model deepseek-chat.

Chart calculation is performed by our own deterministic algorithms and does not use an AI model. AI models are used solely to generate the interpretive text of reports and readings. Service performance and availability may be affected by the operational status of that provider; we will endeavor to communicate significant disruptions in a timely manner.

We are an independent product. We are not affiliated with, endorsed by, or an official application of DeepSeek or any other AI model provider, and we do not present ourselves as such.

2.5 AI-Generated Content Disclosure

All interpretive reports and daily readings provided by the Service are generated by artificial intelligence, using the birth information and chart data you provide. Outputs are labeled as AI-generated. We do not represent AI-generated outputs as the work of a human professional.

2.6 Human Services Not Offered

The Service is software only. We do not offer live consultations, one-to-one readings, video sessions, or any service whose substance is a person performing work for you.

3. Account Registration & Eligibility

3.1 Account Creation

To use certain features, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

3.2 Age Requirement

The Service is intended for users aged 18 and above. By using the Service you represent that you are at least 18 years old.

3.3 Account Security

• Notify us immediately of any unauthorized use at hello@mingcharts.com.
• Do not share your credentials with any third party.
• Keep your billing email address up to date.

3.4 Business Accounts

If you register on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

4. Plans, Reports, and Pricing

4.1 What We Offer

We offer two kinds of paid products:

(a) One-off reports — individually purchased interpretive reports (for example, a full BaZi report, a Zi Wei Dou Shu report, a compatibility report, or a location analysis report). Each purchase grants access to that specific report.

(b) Subscription — recurring access to subscription content, including personalized daily readings and monthly cycle updates, for the billing period selected. See Section 4.3 regarding current availability.

4.2 Plan Changes

We reserve the right to modify plan features, add new products, or discontinue products at any time. Price changes are governed by Section 5.4.

4.3 ★ Subscription — Current Availability

The subscription feature is not yet open for purchase. Until it opens:

• no subscription can be purchased, and no recurring charge can be created;
• the Subscription content described in Section 2.1 is not yet generally available;
• this Section 4.3 will be removed, and Sections 5.1 and 6.1 will be updated with the self-service cancellation path, before subscriptions open.

We state this explicitly rather than describing a feature that does not yet work.

5. Billing & Payment

5.1 Recurring Billing Authorization (Subscription)

(Applies once subscriptions open — see Section 4.3.)

By providing your payment method and subscribing to a paid plan, you expressly authorize MingCharts to charge your payment method on a recurring basis for the applicable subscription fee. This recurring authorization remains in effect until you cancel in accordance with Section 6.

Your subscription renews automatically at the end of each billing period unless cancelled.

★ Renewal notices. We will send you a reminder before each renewal:

• Annual subscriptions — a renewal reminder at least 15 days, and no more than 45 days, before the renewal date;
• All subscriptions — an annual reminder of the subscription, its renewal terms, and how to cancel, regardless of billing period.

These notices are sent to your registered email address and are also shown in your account.

5.2 One-Off Purchase Authorization

Each one-off report purchase is a single transaction. By completing a purchase, you authorize us to charge your payment method for the amount displayed at checkout.

5.3 Taxes and Merchant of Record

Prices are exclusive of applicable taxes (including VAT, GST, sales tax, or similar) unless otherwise stated.

Our payment processor, Waffo Pancake, acts as the Merchant of Record for all transactions. This means Waffo Pancake is the seller of record for your purchase, is responsible for processing your payment, and — where required by applicable law — collects and remits applicable taxes (such as VAT, GST, and US state sales tax) on the transaction. Your order confirmation and receipt are issued in connection with that role.

Payment card data is processed exclusively by Waffo Pancake, a PCI-DSS certified processor, and is never stored on our servers.

5.4 Price Changes

We may adjust prices and promotional policies from time to time. Price adjustments will be communicated through platform announcements or email before taking effect. For subscriptions, price changes take effect only after the end of your current billing period.

5.5 Delivery

Access to purchased content is granted immediately upon confirmed payment, within your account.

6. Cancellation Policy

6.1 How to Cancel

(Subscription is not yet open for purchase — see Section 4.3.)

You may cancel your subscription at any time by sending a cancellation request from your registered email address to hello@mingcharts.com. We will confirm the cancellation by email within 2 business days.

★ Once subscriptions open, a self-service cancellation path inside your account will also be provided — you will be able to cancel online, in the same channel you subscribed through, without contacting us. This section will be updated at that time.

6.2 Effect of Cancellation

• Your subscription remains active until the end of the current billing period.
• You will not be charged for subsequent billing periods.
• One-off reports you have already purchased remain accessible, as they are separate products and not cancelled by a subscription cancellation.
• Account data is retained as described in our Privacy Policy.

7. Refund Policy

7.1 General Policy

Because our products are digital and delivered immediately, fees are generally non-refundable, except as expressly stated below.

7.2 Eligible Refunds

• ★ First-time subscriber 7-day guarantee — A full refund is available to first-time subscribers within 7 days of the initial charge, provided the daily-reading feature has not been used more than a reasonable trial amount.
• Duplicate charge — A full refund for any billing error resulting in a duplicate charge.
• Technical failure — A full refund where a purchased one-off report was never delivered, or was delivered in a materially broken state, and we were unable to remedy it.
• Verified service outage — A pro-rated credit or refund for extended outages (≥72 hours) within our control.
• Statutory rights — If applicable law grants you withdrawal or refund rights (for example, the 14-day withdrawal right for consumers in the EU/UK), those rights are preserved as described in Section 7.3.

7.3 Statutory Withdrawal Rights (EU/UK Consumers)

If you are a consumer habitually resident in the EU or the UK, you may have a statutory right to withdraw from a digital-content purchase within 14 days.

By purchasing and immediately accessing digital content, you expressly request immediate performance and acknowledge that you thereby lose your statutory withdrawal right once the content has been delivered (Article 16(m), Directive 2011/83/EU and equivalent UK provisions). Where you have not accessed the content, your statutory right remains unaffected.

7.4 How to Request a Refund

Contact us at hello@mingcharts.com with your account email, transaction ID, and reason. We will acknowledge within 2 business days and process eligible refunds within 5–10 business days. Refunds are issued to the original payment method.

7.5 Non-Refundable Items

• Subscription periods already used (except as noted in Section 7.2).
• One-off reports that have been delivered and accessed, except where Section 7.2 applies.
• Annual subscription fees requested more than 30 days after initial purchase, except where Section 7.2 or 7.3 applies.
• Accounts terminated for violation of these Terms or the Acceptable Use Policy.

8. Billing Disputes

If you believe there is an error in a charge, please contact us at hello@mingcharts.com before disputing with your bank. We commit to responding within 2 business days and resolving confirmed billing errors within 5 business days.

Recognizing the charge on your statement: card transactions are processed by our Merchant of Record, Waffo Pancake, so your card statement may show a descriptor containing Waffo rather than "MingCharts". If you do not recognize a charge that you believe relates to us, please contact us first — we will help you identify it.

9. AI Output & Intellectual Property

9.1 Ownership of Outputs

Subject to these Terms, AI-generated content produced in response to your inputs ("Outputs") is owned by you. You may use Outputs for any lawful purpose consistent with Section 10.

9.2 Input License

By submitting content to the Service ("Inputs") — including birth date, time, and place — you grant MingCharts a limited, non-exclusive license to process your Inputs solely to deliver the Service. We do not use your Inputs to train AI models.

9.3 Third-Party AI Model Dependency

The Service uses the third-party AI model provider DeepSeek (model deepseek-chat) — see Section 2.4. Outputs may be influenced by that provider's model. We do not guarantee specific output quality and accept no liability for outputs generated by third-party models.

9.4 Accuracy of AI Outputs

AI-generated content may contain errors or inaccuracies. You are solely responsible for reviewing and verifying Outputs before relying on them.

9.5 Our Content

The Service's own content — including chart calculation logic, interpretive frameworks, classification systems, the curated case library and its editorial annotations, text, and design — is our intellectual property and is protected by applicable law. You may not copy, redistribute, or resell it without written permission.

10. Acceptable Use Policy

10.1 Permitted Uses

You may use the Service only for lawful, personal purposes in accordance with these Terms.

10.2 ★ Prohibited Content — The Six Categories

We list these explicitly rather than using a vague catch-all. You must not use the Service to generate, request, store, or distribute content in any of the following six categories:

1. Pornography / NSFW — sexual or sexually explicit content, including any content sexualizing minors;
2. Violence / gore — graphic violence, gore, or content promoting violence against any person or group;
3. Hate speech — content that demeans, threatens, or incites hatred against any person or group on the basis of race, ethnicity, religion, disability, gender, age, or sexual orientation;
4. Child-unsafe content (CSAM) — any content that sexualizes, endangers, or exploits minors. We report apparent child sexual abuse material to the relevant authorities;
5. Deepfakes / impersonation — AI-synthesized content impersonating a real individual, or intended to deceive viewers about its origin or authenticity, including impersonation of a licensed professional;
6. Copyright / trademark infringement — content that infringes the intellectual property, privacy, or publicity rights of any third party, including reproducing copyrighted characters, brands, or trademarked names.

10.3 Other Prohibited Uses

You also agree NOT to use the Service to:

• Generate content that is illegal, defamatory, harassing, or fraudulent.
• Produce malware, phishing content, or cyberattack tools.
• Represent AI-generated outputs as the work of a human professional — for example presenting our reports as authored by a licensed doctor, lawyer, accountant, or financial adviser.
• Use outputs as the basis for medical, legal, financial, or psychological decisions, or present them to third parties as professional advice.
• Request or generate content predicting death, serious illness, disaster, or other harm to any person. Requests of this kind will be refused.
• Resell, sub-license, or operate the Service as a service bureau for third parties without prior written approval.
• Systematically scrape, extract, or harvest outputs at scale for purposes other than your own authorized use.
• Use Service inputs, outputs, or any derivative to train, fine-tune, benchmark, or otherwise develop a competing AI or machine-learning model.
• Circumvent or interfere with security features of the Service.
• Violate any applicable law, regulation, or card network rule.

10.4 ★ Enforcement

When we detect content or behaviour that violates this Section, we may take any of the following actions, depending on severity and recurrence:

• Refuse to generate the requested content, and explain why;
• Remove the offending content from the Service;
• Suspend or terminate the account concerned;
• Withhold or forfeit subscription access or unused prepaid periods, where the violation is material;
• Report to law enforcement where legally required (in particular for category 4).

10.5 ★ How to Report a Violation

If you encounter content on the Service that you believe violates this Section, please report it to us at hello@mingcharts.com with, if possible, the account or link concerned and a short description.

We acknowledge reports within 2 business days and review them; we will tell you the outcome where we are able to. This is a real, monitored channel — it is the same address used for support, billing, and privacy.

10.6 ★ Content Moderation

How moderation works on the Service:

• Input side — chart inputs are structured (date, time, place, gender) rather than free-form, which limits the space for abusive prompts. Where free-text input exists, it is reviewed against the six categories above.
• Output side — our generation pipeline is instruction-constrained to the interpretive task, and the prohibited-content categories above are enforced.
• Automated checks — outputs are screened for the six prohibited categories before being shown.
• Human review — when a check flags content, a human reviews it before display or removal.
• Records — we retain records of moderation decisions and of reports received.
• Continuous update — the prohibited-term and prompt blocklists behind these checks are reviewed and updated on an ongoing basis, not shipped once.

11. Data, Privacy & Security

Your use of the Service is governed by our Privacy Policy at https://mingcharts.com/privacy. Payment card data is processed exclusively by our PCI-DSS certified payment processor (Waffo Pancake) and is not stored on our servers. Account data is retained for 90 days following cancellation, then deleted, except where longer retention is required by law (see the Privacy Policy).

12. Disclaimers & Limitation of Liability

12.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR ACCURACY OF AI OUTPUTS.

12.2 ★ AI-Generated & Metaphysical Content Disclaimer

Outputs are generated by artificial intelligence and are interpretations based on traditional Chinese metaphysical frameworks, not factual predictions. Outputs may be inaccurate, incomplete, or outdated.

Do not rely on them for legal, medical, financial, psychological, or other professional advice. Always consult a qualified professional before acting on any matter addressed by the Service.

Fortune-tier labels. Reports may label a luck cycle or an annual period with one of seven fortune tiers (rendered in Chinese as 大吉 / 吉 / 小吉 / 平 / 小凶 / 凶 / 大凶). These labels are tendency descriptions of a time period, computed by deterministic scoring rules together with the structural conditions shown in the report. They are not action recommendations, they do not predict specific events, and a strongly negative tier (such as 大凶) is not a forecast of harm, disaster, or any concrete event — it describes structural tension in the chart for that period.

Any decisions you make — including decisions about career, finances, relationships, health, travel, or residence — are your own, made at your sole discretion and risk.

12.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MINGCHARTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

12.4 No Guarantee of Availability

We do not guarantee that the Service will be uninterrupted or error-free. We may suspend the Service for maintenance, upgrades, or reasons outside our control.

13. Term & Termination

These Terms remain effective while you use the Service. We may suspend or terminate your account if you materially breach these Terms, we suspect fraudulent activity, or as required by law. If we terminate for reasons other than your breach, we will provide a pro-rated refund for any unused prepaid period.

You may delete your account at any time through your account settings, or by contacting hello@mingcharts.com.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the People's Republic of China.

Before initiating any formal proceedings, please contact us at hello@mingcharts.com to attempt informal resolution. We will attempt to resolve any dispute in good faith within 30 days.

15. General Provisions

We may update these Terms at any time. Material changes will be notified by email or in-product notice at least 30 days before the effective date. Continued use constitutes acceptance.

If any provision is found unenforceable, the remainder continues in full effect.
